Terms of Service

These Terms of Service ("Terms") govern your access to and use of GymTrack, operated by GymTrack ("we", "our", or "us") at gymtrack.net. By signing up or using GymTrack, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using any part of GymTrack, you represent that you are 18 years or older and have the authority to enter into these Terms on behalf of yourself or your organization. If you do not agree, you must not use GymTrack.

2. Description of Service

GymTrack is a cloud-based gym management SaaS platform that provides:

• Member registration and profile management
• Attendance tracking via QR code
• Membership package and subscription management
• Automated invoicing and payment tracking
• Optional SMS integration (bring your own provider)
• Public gym landing page and member self-service portal
• Multi-branch management (Pro and Enterprise plans)

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring your staff use the platform appropriately
• Providing accurate registration information
• The legality and accuracy of member data you enter into the system

You must notify us immediately at hello@gymtrack.net if you suspect unauthorized access to your account.

4. Subscription & Payment Terms

4.1 Plans & Billing

GymTrack is billed monthly. Your subscription renews automatically on the same date each month unless cancelled. Prices are displayed on the Pricing page and are subject to change with 30 days' notice.

4.2 Free Trial

The Starter (single-branch) plan includes a 1-month free trial. Pro and Enterprise plans include a 14-day free trial. No credit card is required to start a trial. We may ask for payment information before upgrading to a paid plan.

4.3 Refunds

We do not offer refunds for partial months. If you cancel your subscription, you will retain access until the end of your current billing period.

5. Acceptable Use

You agree not to use GymTrack to:

• Enter false, misleading, or fraudulent member data
• Violate any applicable laws or regulations in Pakistan, India, or Bangladesh
• Attempt to access another gym's data or circumvent multi-tenant isolation
• Reverse engineer, copy, or resell any part of the GymTrack platform
• Use the platform for any purpose other than legitimate gym management

6. SMS Integration

GymTrack provides integration hooks for third-party SMS providers. You are solely responsible for complying with your SMS provider's terms of service and all applicable telecommunications regulations (including PTA regulations in Pakistan). GymTrack does not sell or provide SMS credits. Any SMS-related costs are billed directly by your chosen provider.

7. Data Ownership

You retain full ownership of all data you enter into GymTrack — including member records, financial data, and content. We process this data solely to provide the service. See our Privacy Policy for details on how we handle your data.

8. Service Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced at least 24 hours in advance. We are not liable for losses caused by service interruptions beyond our reasonable control.

9. Termination

You may cancel your account at any time from your dashboard or by contacting us. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your data is retained for 90 days before permanent deletion.

10. Limitation of Liability

To the maximum extent permitted by law, GymTrack shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of member data, revenue, or business opportunities. Our total liability to you shall not exceed the fees paid by you in the 3 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes arising under these Terms shall be resolved in the courts of Lahore, Pakistan.

12. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email at least 14 days in advance. Continued use of GymTrack after the effective date constitutes acceptance of the updated Terms.
